    Ownership and the law

    Your Child's Words Belong To Your Family.

    The district holds them as a protected education record. IMPACTER processes them under the district's privacy agreement and never owns them.

    FERPA

    A federal law that gives parents, and students once they turn 18, the right to inspect and review education records, ask for corrections, and control most disclosure of information that identifies a student.

    What it means here

    A student’s response is part of the district’s education record. Families inspect, correct or request deletion through the district, or at dataintegrity@impacterpathway.com.

    COPPA

    A federal law covering online collection of personal information from children under 13. When a service is used only for school purposes, the school can consent on the family’s behalf.

    What it means here

    Collection from students under 13 happens with consent through the school. Requests are answered within ten business days.

    CA Ed Code 49073.1

    A California law that sets what a district’s contract with an education technology provider must say: records stay under district control, no targeted advertising, and records are not kept once the contract no longer needs them.

    What it means here

    No targeted ads and no sale. Records stay with the district and family, and are deleted on request.

    Districts decide whether a measurement happens. When they want formal notice with a real opt-out, IMPACTER hosts it at consent.impacterpathway.com in English and Spanish. This is what families receive.

    How Information Is Used, Privacy, And Your Choice

    Responses are evaluated by machine learning against a published rubric validated against expert human readers. Results reach school sites grouped in aggregate at the class, school, and district level.

    The analysis reads the language of the response. It does not analyze images or video. There is no biometric identification of any kind. The evaluation system receives an anonymous identifier and the words, never a student name.

    [District Name] is committed to student privacy. IMPACTER Pathway is a district-approved service provider operating under the district's student data privacy agreement, following FERPA and COPPA.
